#WinWednesday: Judge Affirms 14-Day Stay in Bankruptcy Relief Motions—Thanks to Attorney Cat Davidson

Not every win in bankruptcy court is about wiping out debt—sometimes it’s about making sure existing protections are properly enforced. That’s exactly what happened this week thanks to Attorney Cat Davidson.

In a recent Chapter 7 case, a creditor filed a motion for relief from the automatic stay—a common step when a creditor wants to move forward with actions like foreclosure or repossession during a bankruptcy case.

As part of that motion, the creditor requested that the resulting order be made effective immediately—a request that, until recently, was often granted without much resistance.

But in this case, Cat spoke up.

A Courtroom Win That Protected Time

Cat challenged the creditor’s request to bypass the usual delay, and the judge agreed. In open court, the judge stated that she will no longer automatically grant these requests without a specific and compelling reason.

That meant the order was not effective immediately, and our client received the full time the law allows before any creditor action could move forward.

Why That Extra Time Matters

This wasn’t a change in the law—but it was a clear and important moment of holding the line on existing protections.

For our client, it meant:

  • Two more weeks of breathing room

  • Extra time to explore options

  • No immediate threat of losing property or income
